By accessing or using the Apex Men's Coaching website (the "Site") or engaging in coaching services provided by Sarah Maria ("we," "us," "our"), you ("you," "your," "Client") agree to be bound by these Terms of Use. If you do not agree, please do not use this Site or our services.
The Site is for general information purposes only and any Services described on the Site may only be accessed if you contract with the Company for the provision of certain Services.
Apex Men's Coaching provides life and relationship coaching services (the "Services"). Coaching is not psychotherapy, mental-health treatment, medical advice, or a substitute for licensed clinical care. Sarah Maria is a Certified Men's Coach and is not licensed as a psychologist, psychiatrist, licensed clinical professional counselor, social worker, or physician.
You may use this Site for lawful personal, non-commercial purposes only. You agree not to:
By using the Site, you represent and warrant that: (1) you have the legal capacity to comply with these Terms of Use; (2) you will not access the Site or any log-in through automated or non-human means, whether through a bot, script, artificial intelligence tool, or otherwise; (3) you will not use the Site for any illegal or unauthorized purpose; and (4) your use of the Site will not violate any applicable law or regulation.
Unless otherwise indicated, the Site and the Services offered by us are our proprietary property and all source code, databases, functionality, software, website and mobile application designs, audio, video, text, photographs, and graphics in the Site (collectively, the "Content") and the trademarks, service marks, copyrights and logos contained therein (collectively, the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright, patent, trademark laws and various other intellectual property rights and unfair competition laws of the United States, Canada, international copyright laws, and international conventions.
The Content and the Marks are provided in the Site "AS IS" for your information and use solely in connection with the Site. Except as expressly provided in these Terms of Use, no part of the Site and none of the Site's Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. What you share with Sarah Maria in coaching sessions is held in strict confidence. Coaching is not, however, subject to the same legal privileges as licensed psychotherapy (such as therapist-patient privilege). Confidentiality may be limited where disclosure is required by law, including but not limited to threats of harm to self or others, suspected abuse, or court order.
Testimonials shared on this Site reflect individual client experiences. Results vary from person to person, and there is no guarantee that you will achieve similar outcomes. Coaching outcomes depend in large part on your own willingness, effort, and circumstances.
This Site may link to third-party services (e.g., Calendly, Instagram). We are not responsible for the content, policies, or practices of any third-party site or service.
The Site and the services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event will we or any of our officers, directors, trustees, employees, partners, members, managers or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages whether in contract, tort, strict liability, negligence or any other legal or equitable theory including lost profit, lost revenue, loss of data, direct, indirect, incidental, special, punitive, compensatory or consequential damages of any kind whatsoever resulting or arising from your use of the Site, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount you paid to the Company in the three months preceding the date on which the claim arose, if any, by you.
In certain circumstances, under United States laws and foreign laws, limitations on implied warranties or the exclusion or limitation of certain damages are not valid. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.
We shall not be liable for losses, delays, failure, errors, interruption or loss of data related to the Site occurring directly or indirectly by reason of circumstances beyond its reasonable control, including, without limitation, Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster); action or inaction of civil or military authority; acts of foreign enemies; war; terrorism; riot; insurrection; an EMP event; sabotage; pandemics; epidemics; labor disputes; civil commotion; or interruption, loss or malfunction of utilities, transportation, computer or communications capabilities (a "Force Majeure Event"), and you shall have no right to terminate this Agreement in such circumstances. Any Force Majeure Event shall not preclude any payment obligations you may have to us.
You agree to indemnify and hold harmless Apex Men's Coaching, Sarah Maria, and any affiliates from any claim arising out of your use of the Site or services or your violation of these Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in DuPage County, Illinois.
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) your account with us; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
